Terms of service

These terms govern your use of tinyship, a subscription-based web design, hosting, and maintenance service operated by Aniwear LLC, an Arkansas limited liability company doing business as "tinyship" (referred to in these terms as "tinyship," "we," "us," or "our"). By subscribing to a plan or otherwise using the service, you agree to these terms.

1. The service

tinyship provides website design, hosting, and ongoing maintenance through three monthly subscription plans. The scope of work included in each plan is described below. Scope and volume are interpreted in good faith by tinyship; we reserve the right to ask customers to upgrade plans if the volume or complexity of requests consistently exceeds what is typical for the plan.

Skiff — $29 per month

• One website, hosted on tinyship infrastructure
• SSL certificate, CDN, and basic uptime monitoring
• Domain renewal handled (one standard TLD; you bring the domain or we register it on your behalf with cost passed through)
• One forwarded business email address
• Edits to existing pages — text changes, photo swaps, contact/hours updates, additions or removals of standard sections. Typical turnaround: 1–2 business days.
• Email response within 2 business days
• New pages, custom features, and design refreshes are not included at this tier; see Sail and Crew.

Sail — $59 per month

• Everything in Skiff
• New pages added as needed (menu, FAQ, testimonials, services, gallery, and similar)
• Seasonal refreshes (holiday content, promotions, events)
• Blog posts authored from content the customer provides
• Basic SEO setup (titles, meta descriptions, sitemap, schema markup)
• Email response within 1 business day

Crew — $129 per month

• Everything in Sail
• Custom features (forms, booking widgets, calculators, simple integrations)
• Quarterly design refresh (visual updates to existing pages)
• Unlimited new pages within reason, subject to tinyship's good-faith judgment
• Monthly site-health email (uptime, traffic, security)
• Same-business-day email response, weekdays

2. Billing and cancellation

Subscriptions are billed monthly in advance through Stripe. Plans renew automatically until canceled.

You may cancel at any time by emailing tyler@tinyship.net or through the Stripe customer portal. Cancellation stops future charges. The cancellation takes effect at the end of the current billing period; you retain access to the service through that date.

Past payments are non-refundable except where required by law. Pro-rated refunds for partial months are not provided. If tinyship materially fails to deliver the service as described in these terms (for example, the site is offline for more than 7 consecutive days due to tinyship's negligence), we may issue a credit or refund at our discretion.

3. Your content and intellectual property

You retain ownership of all content you provide (text, images, logos, brand materials, and similar). By subscribing, you grant tinyship a non-exclusive, royalty-free license to use that content solely for the purpose of building, hosting, and maintaining your website.

tinyship retains ownership of the underlying website templates, design system, code patterns, and infrastructure it develops. The customized output specific to your business — your text, images, configuration, and your domain — belongs to you.

Domain ownership

When tinyship registers a domain on your behalf, the WHOIS registrant is your business — meaning you are the legal owner of the domain from the moment it is registered. tinyship is listed as the technical contact and manages renewals while your subscription is active. tinyship pays the registration and renewal fees for one standard TLD (.com, .net, or .org). Premium TLDs (.io, .ai, .design, .law, and similar) are billed at registrar cost, passed through to you.

Handoff on cancellation

When you cancel, tinyship will, within seven business days of your request:

• Domain. Push the domain to your own Cloudflare account at no cost, or unlock it and provide an EPP/auth code so you may transfer it to any registrar of your choice. Outbound transfers are free.
• Site files. Provide a static export of your site in standard formats (HTML, CSS, image assets, and any custom content you provided) so you may host it with any provider.
• Email forwarding. If we set up email forwarding rules at your domain, those transfer with the domain when ownership is moved to your Cloudflare account. If you switch to a different registrar, you will recreate forwarding at your new DNS host.

tinyship does not retain control over your domain or content after cancellation. If you do not request a handoff within thirty days of cancellation, tinyship may release the domain at the next renewal date and delete site files from its servers, after providing reasonable notice.

4. Acceptable use

You agree not to use tinyship for:

• Activities that violate any applicable law
• Hosting illegal content
• Spam, phishing, malware distribution, or other deceptive practices
• Adult content, online gambling, or other categories restricted by our hosting provider's terms
• Activities that materially harm tinyship, our other customers, or third parties

tinyship may suspend or terminate the service immediately for violations of this section, with no refund obligation.

5. Disclaimers and limitations of liability

The service is provided "as is" and "as available." tinyship does not warrant that the service will be uninterrupted or error-free, except as expressly stated in these terms.

To the maximum extent permitted by law, tinyship's total cumulative liability arising from or related to these terms or your use of the service is limited to the total amount you paid to tinyship in the twelve months preceding the event giving rise to the claim. tinyship is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost revenue.

6. Changes to the service or these terms

We may modify these terms with at least 30 days' advance written notice sent to your subscriber email. If you do not agree to the changes, your remedy is to cancel before the effective date. Continued use after the effective date constitutes acceptance.

We may modify or discontinue features of the service. We will not materially reduce the features included in your plan without notice and the option to cancel.

7. Governing law and disputes

These terms are governed by the laws of the State of Arkansas, USA, without regard to its conflict-of-law principles. Any dispute arising from these terms will be resolved in the state or federal courts located in Pulaski County, Arkansas, and you consent to the personal jurisdiction of those courts.
